Privacy Statement, Terms & Conditions of Use

What personally identifiable information is being collected?

We will ask you when we need personal information. Generally, this information is only requested when you are signing up for e-mail newsletters, completing surveys, purchasing and/or registering Barnes products, or requesting information from us. Personal information collected by Barnes usually includes any of the following, but may not be limited to e-mail address, name, address (country and location) and phone number. Other information such as physical credit card numbers and expiration dates are needed for orders placed on the site.

Newsletters and/or notifications sent via e-mail you have registered for by choice, e.g., Club-X, will contain an unsubscribe link. Paid services notifications, e.g., Copper Club, will not contain an unsubscribe link. Please see the procedures listed below to unsubscribe from these types of correspondence under the “What choices are available?” section.

How is your information being used?

When you buy and install a new product, we may ask you to register your purchase electronically. We keep this registration information on file with any information you’ve already given us on previous visits to our Web site.

Barnes Bullets, Inc. also collects certain information about your computer hardware and software. This information may include: your IP address, browser type, operating system, domain name, access times and referring Web site addresses. We reserve the right to compile and publish profile information about our visitors to provide general statistics regarding the use of our site. These statistics are never linked with personal information.

Under what circumstances is your personal information disclosed?

Barnes may disclose your personal information if required to do so by law or in the good-faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Barnes or the site; (b) protect and defend the rights or property of Barnes, or (c) act in urgent circumstances to protect the personal safety of Barnes employees, users of Barnes products or services, or members of the public.

Your information may be stored and processed in the United States or any other country in which Barnes or its affiliates, subsidiaries or agents maintain facilities, and by using this site, you consent to any such transfer of information outside of your country. Barnes abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of data from the European Union.

What choices are available to you regarding the collection, use and distribution of information and how can you correct any inaccuracies in information?

If you do not want to receive e-mails from us in the future please let us know by sending us an e-mail to email@barnesbullets.com or by writing to us and telling us that you do not want to receive correspondence from our company. You may use this procedure to alert us to any change in e-mail address or other personal information.

If you provide us with your postal address, you may receive periodic catalogs, information on new products and services or upcoming events. If you do not wish to receive mailings, please let us know by sending us an e-mail to email@barnesbullets.com or writing to us. Please provide us with your exact name, e-mail address and postal address. We will be sure your name is removed from the mailings of this information.

If you provide us with your telephone number or facsimile (fax) number, you may receive telephone or fax contact from us with information regarding your orders or requests for information. Please provide us with your correct phone numbers or fax numbers so we can contact you when we have a problem with your order. Your telephone and/or fax number will not be given to any other company or used for any other purpose.

Security of your Personal Information

Barnes is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to ensure that your personal information is safeguarded from unauthorized access, use or disclosure. For example, we store the personal information you provide in computer servers with limited access that are located in controlled facilities. When we transmit sensitive information (such as a credit card number) over the internet, we protect it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

The Barnes Bullets Web site is a general audience site. Barnes does not knowingly collect any personal information from children.

Use of Cookies

When someone visits the site, a cookie is placed on the customer’s machine (if the customer accepts cookies) or is read if the customer has visited the site previously. One use of cookies is to assist in the collection of the site visitation statistics described above in the “How is your information being used?” section.

Changes to this Statement

Barnes will occasionally update this Privacy Statement. When we do, we will also revise the “last updated” date at the top of the Privacy Statement.

Ownership of Intellectual Property

The trademarks, service marks, brand names, and logos appearing on this site are owned by Barnes Bullets, Inc. Nothing contained herein shall be construed as granting any license or right to use any trademarks, service marks, brand names, or logos appearing on this site without the express written permission of the owner. You may not frame or utilize framing techniques to enclose any trademarks, brand names, service marks, logos, or use any meta tags or any other “hidden text” utilizing Barnes’ trademarks, brand names, or service marks without the express written consent of Barnes Bullets, Inc.

Governing Law

This Agreement is made in and shall be governed and construed by the laws of the State of Utah, United States of America, without reference to conflicts of laws. If you access this site from locations outside Utah or the United States, you are voluntarily and purposefully availing yourself of the laws of the State of Utah, United States of America, and you are solely responsible for compliance with all your local laws. Access to this site from locations where this site’s contents may be unlawful is prohibited.

All actions, claims, or disputes arising under or relating to this Agreement shall be brought in the federal or state courts located in Salt Lake County, Utah. You hereby irrevocably waive any and all objections which you may now or hereafter have to the exercise of personal and subject matter jurisdiction by the federal or state courts in Salt Lake County, Utah and to the laying of venue of any such suit, action, or proceeding brought in any such federal or state court in Salt Lake County, Utah.
